EB-5 and its growth in the Indian Market
October 13, 2016

In 2015 over 98% of the Immigrant Visas through the EB-5 program (156 of 9,764 visas), were issued through the EB-5 Regional Center Program. The EB5 Regional Center program is also the clear choice for most Indian investors. The EB-5 Regional Center program is currently due to expire on September 30, 2016. If the EB-5 Regional Center program is not extended on or prior to September 30, 2016, it will simply cease to exist.

The EB-5 Regional Center program has been due to expire a couple of times in the past but has been extended each time. On September 30th things may be different and the EB-5 Regional Center Program may simply be allowed to expire. If the program expires, hundreds of Indian investors will lose the opportunity to obtain an investment-based “green card”.

In order for the EB-5 program to be extended beyond September 30, 2016, the extension needs be authorized by both the United States Congress and the House of Representatives. In the past the program has received support from leading politicians in the United States. However, this time Senior Members of the House of Representatives have demanded significant changes to the EB-5 Regional Center program if it is to be extended beyond September 30. These demands have been made through a written statement, a copy of which is available from our offices. Multiple unsuccessful attempts to negotiate such changes have been made over extensive periods in the past. Given the time period involved and the pending US election, changes seem unlikely to be negotiated before September 30th and it seems as though the EB-5 Regional Center program might simply cease to exist as of September 30, 2016.

Our law firm specializes in assisting Indian EB-5 applicants from every corner of India and with a “no denials” history we are recognized as the leading US law firm assisting Indian EB5 applicants. We believe that unlike in the past there is a substantial chance that the EB5 Regional Center program will be allowed to expire on September 30th.

In such circumstances we are urging our clients who are interested in filing for an EB-5 Visa through a Regional Center to do so by Friday, September 30, 2016.

EB-5: Is there Time?

There is still time to file for an EB-5 Petition before September 30th. Because of the crucial and extremely tight deadline clients wishing to participate in the EB5 Program are advised to contact our firm or another an experienced EB5 lawyer immediately.

EB-5 Regional Center: Which Project?

At the current time there are a very small and discrete number of Regional Centers with truly outstanding EB5-qualifying projects. In an environment where many “consultants” are paid commissions by Regional Centers and lawyers who claim to be independent advisors also represent Regional Centers, finding the best and the most suitable Regional Centers and projects can be challenging.

Davies & Associates, LLC is truly independent and only represents investors in EB-5 projects. Our clients have chosen to invest with only a handful of carefully selected Regional Centers, have never suffered any loss and have always had their Petitions approved without exception. We take the interests of our investor clients extremely seriously have the leading team of US lending, Indian and US immigration lawyers to protect their interests.
